Support Your Local Police: Our Heroes In The Streets

20151021 Support Our Heroes Flyer

Don’t miss this important lecture !!! James Fitzgerald will discuss the current administration’s drive to assemble a national police force. Using federal and state grants, Washington and Harrisburg have encouraged local police department mergers, additional federal and state-run task forces, federal and state training & technical assistance programs, mitlitarization of our local police forces, and Local-DOJ cooperatives. Ladies & gentlemen: federal money always comes with federal strings attached.  Jim will shed some light on the many “strings” Washington is planning to foist on your local law enforcement agencies. As the power structure of your community police departments is transferred to bureaucrats in Washington, the people become more alienated from those who are charged with their protection. A national police force is a hallmark of tyrannies world-wide. The Department of Homeland Security would like nothing more than to control the officers on our streets. According to Rahm Emanuel, “You never want a serious crisis to go to waste.” Well the recent Ferguson and Baltimore unrest are the most recent crises being used to fuel the drive towards a police-state in America. If you think this assessment over-states the situation I invite you to investigate the White House Initiatives listed below.

Jim will help you to see where these in-roads are at play. Learn about this problem, share the information with your friends and neighbors, support your local officers, pressure your local officials to refuse the money, maintain their independence from the regulations and maintain our freedom. The law should be your friend not something you fear. Click the image above for a downloadable flyer or click here.

This lecture is a volunteer run project in need of funding to offset the expenses associated with: room rental, lodging & meals, travel, printing, advertising etc. Please support this effort through a donation or advertise your business, group, blog, book, etc in our program booklet. Our fundraising appeal letter contains all the details on supporting the program. Please email me or contact the person sharing this with you if you need to purchase tickets in advance or wish to order flyers for distribution or display.

The Trayvon Martin Case, Double Jeopardy, and a Triple Threat

with 2 comments

Double Jeopardy in Jeopardy
Regardless of how you interpret the not-guilty verdict in the Zimmerman trial, all Americans should be concerned about the Federal Government launching a civil hate-crimes case against George Zimmerman. The Constitution provides protection against “Double Jeopardy”. It is in the best interest of all Americans to make sure our rights in this regard are protected. Even if it means allZimmermanowing an injustice to prevail, it is critical that the federal government not be allowed to drag a defendant though repetitive trials. If Zimmerman can be indicted twice for the same crime, where does it end? Theoretically, he could be charged every time someone were to come forward with “new evidence” and he would have to live out his days in fear of a government indictment for an issue already resolved by a jury of his peers. Now, forget we are talking about George Zimmerman.  Put yourself into his shoes, because once the precedent is set, we will all be subject to similar prosecutorial irregularities. Let’s review the major milestones of the case and then summarize the threat to our Constitution.

Summary of the Altercation
George Zimmerman, a 28 year old Hispanic neighborhood watch coordinator within a gated community in Sanford Florida, had an altercation with Trayvon Martin, a 17 year old black high school student who was residing within that community. The altercation occurred on February 26, 2012 and ultimately resulted in a lethal use of force. Mr. Zimmerman discharged his weapon amidst the struggle which had ensued and Trayvon Martin was mortally wounded.

Police Action
On March 12, 2012, Police Chief Bill Lee turned the investigation over to the State Attorney’s office for review. He stated that Zimmerman had alleged self-defense and that unless probable cause could be shown to dispute that statement, the state had no cause for arrest. On March 13, 2012, Chris Serino, the lead investigator, filed a capias request, recommending that the State charge Zimmerman with negligent manslaughter, although he was doubtful that sufficient evidence existed to prosecute. Apparently both law enforcement officer’s opinion was confirmed by the State Attorney’s Office as they did not file any charges at that time.

By-Passing the Grand Jury
On March 20, 2012, State Attorney, Norm Wolfinger declared his intention to convene a grand-jury on April 10th to investigate and decide if an indictment should be handed down.  Simultaneously, the Justice Department opened a Civil Rights investigation. Meanwhile, Governor Rick Scott, asked the Florida Department of Law Enforcement to investigate. On, March 22, 2012, Governor Rick Scott assigned State Attorney Angela Corey to the case. She promptly decided that her office would decide whether or not to press charges stating, “I always lean towards moving forward without needing the grand jury in a case like this, I foresee us being able to make a decision, and move on it on our own.” On April 11th, George Zimmerman was charged with 2nd degree murder. On July 13, 2013, the jury found the defendant not guilty.

The Aftermath
According to CNN’s, State of the Union, broadcast last week, The National Association for the Advancement of Colored People are pushing for federal action. Ben Jealous, President of the NAACP, is pushing for US Attorney General Eric Holder to pursue a hate crimes charge against Mr. Zimmerman.

A Triple Threat To All Americans
What are the police powers of the Federal Government? Let us look into the Constitution:

Article I Section 8 paragraph 6
The Congress shall have the power… To provide for the punishment of counterfeiting the securities and current coin of the United States.

paragraph 10
The Congress shall have the power… To define and punish piracies and felonies committed on the high seas, and offences against the law of nations.

Article 3 section 3
Treason against the United States shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort.

In summary, all laws that seek to create federal crime out of certain behavior not associated with counterfeiting, piracy or Treason are unconstitutional. The “law of nations” refers to laws governing the acceptable treatment of one nation regarding another so that clause would not apply to the actions of the civilian population. Even the impeachment power of the Federal Government holds no criminal authority. Impeachment is simply a governmental procedure for removing a member from government. Any criminal proceedings associated with an impeachment are handled by the appropriate authorities, and are sometimes but not necessarily a federal criminal case. Therefore, it is an abuse of power for the federal government to classify a whole host of new federal crimes including hate crimes. These suggested laws should be considered at the State level.

Threat #1: There is no justification for the Federal Government to assume original jurisdiction with regard to an act of violence committed by one citizen against another within the boundaries of a state.

Threat #2: In the Trayvon Martin case, an indictment of a grand jury was never handed down.

Threat #3: Even so, a trial was held and a jury of peers rendered a verdict. From a legal perspective, the case is settled and any subsequent indictment based upon the same offense would violate the protection against double jeopardy. The 5th Amendment applies …

US Constitution 5th Amendment

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury … nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb.

State Senator Anthony H Williams Should Be Nullified

leave a comment »

I just read Senator Anthony H. Williams letter in response to the growing momentum behind House Bill 357 which would nullify attempts by the federal government to impose restrictions on the rights of law-abiding citizens within the Commonwealth of Pennsylvania to exercise their right to bear arms. The bill rightly, sends a message to the government in Washington that: 1) the Commonwealth intends to defend the natural right of its citizens to defend itself, and that 2) the Constitution of Pennsylvania is not subject to unlimited restrictions from the general government.

Senator Williams does not agree. His argument is fraught with deception and false platitudes. He presents a false argument in his opening sentence when he says:

The history and heritage of this great nation long has included a constant and vigilant dance between preserving individual freedoms and advancing social harmony.

Excuse me? What are you saying Senator? Am I to understand that there are times when preserving individual freedom is contrary to social harmony? No, your job is not to participate in some mystical dance or vigilant tight-rope walk! Your job is to defend the constitution of your state and the rights of its people.  After all, the purpose behind the constitution is the establishment of social harmony. Just do your job and the social harmony you speak of will be a matter of natural consequence.

This bill, which enjoys the support of over 75 co-sponsors is a reassertion of the rights of the States as codified in the Ninth and Tenth amendments of the federal constitution, however, Senator Williams finds it ludicrous to be part of a

… rising, and disturbing, national cognitive capture of nullification… based on severely flawed ideas and deserves immediate repudiation, if not condemnation

Senator, am I to understand that the ninth and tenth amendments are the severely flawed ideas of which you speak? Williams goes on to boast of his hometown’s prominent role in this nation’s establishment. He wants us to assume that he has a special insight into the foundation of our nation based solely on his nativity. He  pays a pretended homage to the Second Amendment and then pits it against common sense. Apparently, “The right of the people to keep and bear arms shall not be questioned.” (PA State Constitution) is not to be considered common sense in 21st Century Pennsylvania. He also seems to be under the delusion that “checks and balances” against the concentration of power in Washington is some how in opposition to the concept of “liberty and justice for all”. How is it sir, that liberty and justice can exist outside the confines of a duly erected, defined and defended constitution which establishes a framework under which our several governments must operate? How can serenity exist if chaos is allowed to proceed unchecked?

Senator, you speak of “allegiance to our nation and its operation”. I say, allegiance is a two-way street. We should bear true allegiance in so far as Washington operates within the confines of its enumerated powers. The American people established the general government through its states and reserved power unto itself. To the extent to which Washington recognizes its legitimate authority it is owed our allegiance. To the extent to which Washington seeks to abrogate the God-given rights of the people of Pennsylvania it is owed our scorn.

Senator Williams also believes the essence of the Supremacy Clause is:

Being part of the United States of America means we agree to being bound by federal laws set forth, whether our ideals are aligned with or repudiated by said laws.

The Senator conveniently omits that the Supremacy Clause includes the phrase “under the authority of the United States”. We are not bound by laws contrary to the authority granted the United States. Those powers not delegated to the general government are reserved to the people. No state ratified the Constitution under the premise that they would be bound by unconstitutional laws. Who is being ludicrous now?

In short Senator, there is no contradiction between your charge to “uphold the welfare of our neighbors”, the defense of the second amendment, “the advancement of social harmony” and HR 357. No, in fact, HR 357 and other nullification measures are required, since the Supreme Court refuses to recognize that our Federal Constitution is a grant of limited and well defined powers.

Residents in the 8th district of Pennsylvania should now take notice, that State Senator Anthony H. Williams is on record. He feels it is his duty for the sake of unity to compromise your liberty !

Get US Out of the United Nations Speech by John F. McManus

leave a comment »

Get-US-Out2

The United Nations has been a threat to the United States since its inception in 1945. It attacks property rights through its Agenda 21, it masacres and enslaves entire populations of the third world, it fosters wars and undermines the sovereignty of member nations. Through so-called “free trade” it redistributes the wealth of the world amongst its member nations and builds word socailism in the process. The UN attacks our children by driving a wedge into the family unit, it promotes a dangerous educational agenda and pushes world-wide abortion and euthenasia as so called reproductive and family planning rights. The UN also fosters the creation of multi-national coalitions which provides a forum for international bullying that naturally leads to the formation of opposition coalitions and drags our world closer to another major confrontation.

Come hear John F McManus discuss the origins of this powerful institution, its current players and its present threats. Learn how to fight back and rid our nation of this modern day Trojan Horse.
