Homeland Security Says it can strip search you.
The Department of Homeland Security told a federal court that the agency believes it has the legal authority to strip search every air traveler. The agency made the claim at oral argument in EPIC’s lawsuit to suspend the airport body scanner program. The agency also stated that it believed a mandatory strip search rule could be instituted without any public comment or rule making.
That’s a strange attitude if you ask me. I seem to recall something in the US Constitution that would prohibit that.
The Fourth Amendment to the US Constitution
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
